Terms of Service

1. Service Description
Prometheus AI ("the Service") is an Autonomous Defense Platform operated by RocketCore LLC ("Company," "we," "us"). The Service includes AI-powered security monitoring, endpoint agents, threat detection engines, automated incident response, and related tools delivered via cloud-hosted software and locally installed agent software.
2. Account Terms
By creating an account, you agree to the following:
- You must be at least 18 years of age and authorized to act on behalf of your organization.
- You are responsible for maintaining the confidentiality of your account credentials, API keys, and HMAC secrets.
- You must provide accurate and complete information during registration and keep it up to date.
- You are responsible for all activity that occurs under your account, including actions taken by deployed agents.
- You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:
- Use the Service to monitor systems or networks you do not own or have explicit authorization to monitor.
- Attempt to reverse engineer, decompile, or extract source code from the platform or its ML models.
- Use the Service to conduct offensive security operations (penetration testing, red teaming) against third parties without their written consent.
- Resell, sublicense, or redistribute the Service without a valid reseller agreement.
- Interfere with, disrupt, or overload the Service infrastructure, including abusing API rate limits.
- Use the detection data or threat intelligence feeds to build a competing product.
4. Data Processing
The Service collects and processes security telemetry from your endpoints, including process activity, network connections, authentication events, DNS queries, and file system changes. This data is used solely for threat detection, model training, and service improvement. Our data handling practices are described in detail in our Privacy Policy. By using the Service, you consent to the collection and processing of security telemetry as described therein.
5. Subscription and Payment
Paid plans are billed monthly in advance via Stripe. You authorize us to charge your payment method on file for all applicable fees. If payment fails, we will attempt to collect up to three times before suspending your account. The Starter plan (up to 3 endpoints) is free and does not require a payment method. Plan pricing, features, and endpoint limits are as published on our Pricing page and may be updated with 30 days' notice.
6. Intellectual Property
The Service, including its detection engines, ML models, kill chain orchestrator, APIs, agent software, documentation, and all associated intellectual property, is and remains the exclusive property of RocketCore LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period. Your security telemetry and configuration data remain your property.
7. Limitation of Liability
To the maximum extent permitted by law, RocketCore LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or damages resulting from security incidents that the Service failed to detect or prevent. The Service is provided as an additional layer of defense and does not guarantee the prevention of all security threats. Our total aggregate liability under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. The agent software is designed to operate independently during platform outages, queuing events locally for later transmission. We are not liable for unavailability caused by factors outside our control, including network failures, third-party service outages, or force majeure events.
9. Termination
Either party may terminate this agreement at any time:
- By you: Cancel your subscription through the Client Portal or by contacting support. Cancellation takes effect at the end of the current billing period.
- By us: We may suspend or terminate your account immediately for violation of these Terms, non-payment after three failed collection attempts, or if required by law.
Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination. After 30 days, we will delete your account data in accordance with our Privacy Policy.
10. Governing Law
These Terms and any disputes arising out of or related to these Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States of America, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Tennessee, and you hereby consent to the personal jurisdiction and venue of such courts.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
